Terms of Service

These Terms of Service govern your use of the Fix My Sticks mobile app and marketplace platform, operated by SALIXIA LLC. By creating an account or using the platform, you agree to these terms.

SMS / Text Messaging

By providing your phone number during provider registration and tapping "Send Code," you expressly consent to receive a one-time SMS verification code from Fix My Sticks (SALIXIA LLC) at the number provided.

Message frequency: One message per verification request. No recurring marketing messages.

Message & data rates may apply.

Carriers are not liable for any delayed or undelivered messages.

Your phone number will not be shared with third parties for marketing purposes.

1. Overview

Fix My Sticks ("Platform," "we," "us," or "our") is a mobile application and service marketplace operated by SALIXIA LLC that connects customers with independent golf club repair service providers ("Providers"). By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms").

2. Eligibility

You must: (a) be at least 18 years old; (b) provide accurate and current account information; and (c) use the Platform in compliance with all applicable laws.

3. Nature of the Platform

Fix My Sticks is a technology platform only. We facilitate connections between customers and Providers and provide booking and payment processing tools. We do not perform repair services, employ Providers, or guarantee service quality.

4. Independent Contractors

All Providers are independent contractors, not employees, agents, or partners of Fix My Sticks. We do not control how services are performed, supervise Providers, or guarantee outcomes. Providers are solely responsible for the quality of their work.

5. User Accounts

You agree to keep your login credentials secure, provide accurate and current information, and notify us immediately at support@fixmysticks.net if you suspect unauthorized use. We reserve the right to suspend or terminate accounts at our discretion.

6. Bookings & Payments

Customers book services through the Platform. Payments are processed securely via Stripe and held until the service is completed and confirmed. All payments must be completed through the Platform — circumventing the Platform to arrange off-platform payments is prohibited.

7. Platform Fees

Fix My Sticks charges a platform service fee (currently 15%) on each completed transaction. This fee is automatically deducted from Provider earnings before funds are disbursed. We reserve the right to modify fees with reasonable advance notice.

8. Cancellations & Refunds

Customers receive a full refund if a Provider cancels or if the customer cancels before work begins. Fix My Sticks may issue refunds at its discretion. Disputes are reviewed by our team and resolved at our discretion.

9. User Conduct

You agree NOT to: (a) bypass the Platform for payments; (b) engage in fraud or misrepresentation; (c) harass, threaten, or harm other users; (d) upload false or misleading information; or (e) attempt to reverse-engineer or disrupt the Platform. Violations may result in account suspension or termination.

10. Ratings & Reviews

Customers may leave ratings and reviews after a completed service. Fix My Sticks reserves the right to remove inappropriate content and uses ratings to rank and surface Providers on the Platform.

11. No Background Check Guarantee

Fix My Sticks does not guarantee that background checks have been performed or that Provider credentials are verified. Users engage with Providers at their own risk.

12. Limitation of Liability

To the fullest extent permitted by law, Fix My Sticks is not liable for: damage to golf clubs or equipment; service quality or outcomes; delays or cancellations; loss, theft, or misuse of property; or any indirect, incidental, special, or consequential damages arising from your use of the Platform.

13. Disclaimer of Warranties

The Platform is provided on an "as is" basis without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

14. Payment Processing

Payments are processed by Stripe. By using the Platform, Providers agree to Stripe's Connected Account Agreement. All users agree to applicable payment processing terms.

15. Taxes

Providers are solely responsible for all federal, state, and local taxes, including income tax, self-employment tax, and any applicable sales or local taxes. Fix My Sticks and Stripe may issue tax forms such as 1099-NEC or 1099-K where required by law.

16. Intellectual Property

All content, branding, and software on the Platform are owned by SALIXIA LLC or its licensors. You may not copy, reproduce, or use Platform branding without our prior written permission.

17. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

18. Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent or harmful activity, or for any conduct that harms other users or the Platform.

19. Dispute Resolution

Users agree to attempt to resolve disputes through the Platform first. Fix My Sticks may act as a mediator but is not a party to disputes between Customers and Providers.

20. Modifications

We may update these Terms at any time. Continued use of the Platform after notice of changes constitutes acceptance of the updated Terms.

21. Governing Law

These Terms are governed by the laws of the State of California.
